1. Acceptance of Terms

By accessing or using arkenk ("the Service"), you agree to be bound by these Terms of Use. If you do not agree, do not use the Service. arkenk reserves the right to modify these terms at any time.

2. Nature of the Service

arkenk is a non-custodial software interface. It provides tools to interact with public smart contracts deployed on the Solana blockchain. arkenk does not:

• Custody, control, or have access to your funds or private keys
• Execute transactions on your behalf — all actions require your wallet signature
• Provide financial, investment, tax, or legal advice
• Guarantee any outcome, return, or token value

3. Eligibility

You must be at least 18 years old and legally permitted to use blockchain-based services in your jurisdiction. By using arkenk, you represent and warrant that you meet these requirements.

4. User Responsibilities

You are solely responsible for:

• Securing your wallet and private keys
• Verifying all transaction details before signing
• Complying with applicable laws and regulations in your jurisdiction
• Any tokens you create, including their use, distribution, and marketing
• Understanding the risks associated with blockchain transactions, which are irreversible

5. Fees

arkenk charges service fees as displayed in the interface at the time of transaction. Fees are collected on-chain in the same transaction as the token creation. Solana network fees (gas) are separate and determined by the network. All fees are non-refundable.

Cashback. Eligible users may receive up to 1 SOL in cashback. To qualify, you must have used more than 10 SOL in total token-creation activity on arkenk. The cashback is discretionary and promotional — it is not guaranteed, may be changed, paused, or discontinued at any time without notice, and is paid at arkenk's sole discretion. Cashback does not constitute a refund of fees, and arkenk may apply additional eligibility, anti-abuse, or verification requirements before any payout.

6. Intellectual Property

The arkenk interface, branding, and design are proprietary. You may not copy, modify, or distribute any part of the Service without prior written consent. Tokens you create are your own — arkenk claims no ownership over user-generated content or on-chain assets.

7. Limitation of Liability

arkenk is provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted by law, arkenk shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of funds, token value depreciation, smart contract bugs, or network failures.

8. Prohibited Activities

You agree not to use arkenk to:

• Create tokens for fraudulent, deceptive, or illegal purposes
• Impersonate other projects, individuals, or organizations
• Violate securities laws or regulations in any jurisdiction
• Engage in market manipulation, pump-and-dump schemes, or rug pulls
• Attempt to exploit, hack, or disrupt the Service or its underlying infrastructure

9. Termination

arkenk reserves the right to restrict or terminate access to the Service at any time, for any reason, without prior notice. On-chain assets and tokens you have already created remain yours regardless of account status.
